Norfolk Board of Health Adopts Tobacco Regulation, Exempts Oral Nicotine Pouches

Norfolk Board of Health unanimously adopted a new tobacco sales regulation but stripped out a proposed cap on oral nicotine pouches, allowing higher-strength products to remain on store shelves. The board voted 3-0 at its January 30 meeting to approve the regulation effective May 1, 2026, with section G — which would have barred the sale of pouches containing more than six milligrams of nicotine per pouch — removed entirely after a convenience store category manager identified only as Anna told the board the affected nine- and twelve-milligram products represent roughly 15 percent of her stores' total tobacco sales. Clerk John Bowman said he was unwilling to "take a vote that's going to have an adverse impact on a resident of Norfolk being able to put food on the table." Chair Andy Bakinowski noted that a UMass report submitted by the retailer was filled with "limited evidence" language and concluded only that more data is needed.

The board will revisit the oral nicotine pouch question in January 2027. In a separate unanimous vote, the board approved a Title V septic system variance for 15 Ware Drive, accepting engineer John Glosser's plan for a 1,500-gallon tank and 468-square-foot Presby leach field on a 10,000-square-foot lot owned by Marty and Tammy Malone, with a 40-mil PVC impervious barrier substituting for a standard foundation setback.
