Foxborough Conservation Commission Clears Heaton's Boatyard for Sale, Hears Five Cases

Foxborough Conservation Commission cleared title on Heaton's Boatyard and certified wetland boundaries for a 50-acre Main Street parcel at its July 13 meeting. Attorney Jeff Lovely, personal representative of the Heaton estate, told the commission that MassDEP had audited and confirmed a 2023 final cleanup report for the oil spill at 68 Neponset Heights Road, stating the remediation was "performed in compliance with the requirements of the MCP" with no activity use limitation; the commission voted unanimously to issue a certificate of compliance for DEP 157-607, clearing the way for a property sale and a potential reopening of the boatyard as soon as this summer. At 62 Main Street, the commission accepted wetland boundary delineations prepared by Lauren Gluck of PAR Corporation for Century Company across three parcels, including a confirmed vernal pool in the B-series wetland complex with a 100-foot protective buffer.

A proposed single-family home at 90 Mill Street for Jackson Homes LLC was continued to July 27 pending a DEP response on whether the commission may formally designate a stream as intermittent based on two expired predecessor permits.
