Wellesley Wetlands Panel Issues Three Orders of Conditions at July Meeting

Wellesley Wetlands Protection Committee issues three orders of conditions and flags enforcement concerns at Waterstone site. At its July 30 Zoom meeting, the three-member quorum of Chair Eleanor McLane, Doug Hersh, and Jim Mclaren approved orders of conditions for 11 Winding River Circle, 900 Washington Street (Cheney Drive), and 66 Northgate Road, and granted negative determinations of applicability to homeowners at 68 Dover Road and 3 Winding River Circle. The committee unanimously waived all fines, including accrued daily fines of $300 per business day and a prior reporting fine, against the responsible party at 3 Sunnyside Avenue after the required plantings were confirmed completed on July 12.
The most significant discussion centered on 27 Washington Street, where staff found roughly half of 27 installed shrubs dead or dying, two trees and approximately 160 ferns unplanted, and no Waterstone representative present despite advance notice; McLane said the situation may warrant requiring an after-the-fact notice of intent and directed staff to investigate the committee's authority to do so. A certificate of compliance for 45 White Oak Road and a new notice of intent for a home demolition and replacement at 235 Weston Road were both continued to August 20, pending an engineering report on a rain garden slope and a revised stormwater and tree-protection plan, respectively.
